Ten years later, DC sniper says he felt like "scum"

WASHINGTON (Reuters) - Convicted Washington sniper Lee Boyd Malvo said the devastated reaction of a victim's husband 10 years ago made him feel like "the worst piece of scum on the planet," The Washington Post reported on Sunday.

In a rare interview, Malvo, 27, urged the families of victims to try to forget about him and his partner, John Allen Muhammad, so they can get on with their lives.

Tuesday marks the 10th anniversary of the start of Malvo and Muhammad's deadly rampage in the Washington area. The pair was linked to 27 shootings across the country, including 10 fatal attacks in the Washington area over 23 days.

Malvo, who was 17 at the time, said the look on the face of victim Linda Franklin's husband when she was shot stood out in his memory of the killing spree.

Muhammad killed Franklin, a 47-year-old FBI analyst, as she and her husband Ted loaded purchases at a Home Depot in Falls Church, Virginia. Malvo, armed with binoculars, acted as spotter.

"It is the worst sort of pain I have ever seen in my life," he told the Post of Ted Franklin's eyes.

"Words do not possess the depth in which to fully convey that emotion and what I felt when I saw it ... You feel like the worst piece of scum on the planet."

Malvo is serving a life sentence without parole at a Virginia prison for killing Franklin. Muhammad, a Gulf War veteran, was executed in Virginia in 2009.

The attacks 10 years ago terrorized the U.S. capital. People were shot at random in parking lots and at grocery stores, and a 13-year-old boy was wounded outside his school.

Malvo and Muhammad carried out their attacks with a rifle fired from the trunk of a Chevy Caprice until authorities tracked them down at a Maryland rest stop.

Malvo also repeated assertions that the older Muhammad manipulated him. But he said: "I was a monster. If you look up the definition, that's what I was."

Malvo said there was no way to convey an apology to the victims' families.

"There's nothing that I can say except don't allow me and my actions to continue to victimize you for the rest of your life," he said.

"Don't allow myself or Muhammad to continue to make you a victim for the rest of your life. It isn't worth it."

Insight: Three lawyers ask U.S. Supreme Court: Why here?

(Reuters) - For more than three decades survivors of human rights abuses in foreign countries have turned to U.S. federal courts to seek justice. On Monday the U.S. Supreme Court hears a case that could make that impossible.

The case pits a Nigerian widow against a multinational oil company. Esther Kiobel and others say Royal Dutch Petroleum (Shell) helped the Nigerian government commit human rights violations against her husband, who was executed in 1995. Shell has denied the allegations and argues that cases involving foreign governments committing atrocities in their own countries do not belong in the U.S. court system at all.

That the justices are considering the sweeping question of whether an entire class of lawsuits can be heard in the United States can be traced to briefs filed by three lawyers whose clients aren't even involved in the case.

How their briefs came to be sheds light on one of the most closely watched cases before the Supreme Court this term and shows how the efforts of private lawyers pursuing a public policy goal can have momentous consequences.

A ruling against Kiobel could wipe out lawsuits pending against companies such as Exxon Mobil Corp, Rio Tinto Plc and Nestle, which are accused by private plaintiffs of helping governments violate human rights in Indonesia, Papua New Guinea and Ivory Coast, respectively.

Esther Kiobel's husband, Barinem Kiobel, was arrested in 1994 along with Nobel Peace Prize nominee Ken Saro-Wiwa and others. They had spoken out against the government's violent suppression of environmental activists who opposed Shell's oil and gas drilling in Nigeria. Kiobel was found guilty of murder by a Nigerian military court in a trial that the U.S. State Department said lacked due process, and he was hanged in Port Harcourt, Nigeria, in 1995.

With no recourse in Nigeria, Esther, who had received asylum in the United States, filed a lawsuit in federal court in New York alleging among other things that Shell cooperated with the Nigerian military, resulting in crimes against humanity. She relied on a 200-year-old U.S. law called the Alien Tort Statute. (For a history of the Alien Tort Statute, click on [ID:nL1E8KSKLE].) While the case was under way, Shell won a ruling in September 2010 from the influential 2nd U.S. Circuit Court of Appeals that said Shell could not be held liable under the statute because it was a corporation. It was a major shock to human rights lawyers, who had brought more than 100 such cases against corporations in the previous two decades.

TEAMING UP AGAIN

The ruling quickly caught the attention of John Bellinger, an attorney at the law firm Arnold & Porter. In a series of interviews with Reuters, Bellinger, 52, discussed his actions over the subsequent 18 months. He stressed that he was speaking in a private capacity rather than as a representative of his clients in the Kiobel case.

Bellinger believed Kiobel's lawyers were likely to petition the Supreme Court. Sure enough, in October 2011 the court agreed to take the case on the narrow question of whether corporations could be held liable under the statute.

Bellinger, who had been State Department legal adviser in the Bush administration, had bigger ideas. He wanted to present the court with arguments he had heard from foreign governments while he was at the State Department. Back then, Australia, Britain, Canada and others had protested when cases were brought under the Alien Tort Statute. They argued that U.S. courts had no business judging events that took place on foreign soil.

When the Supreme Court accepted the Kiobel case, Bellinger started emailing and calling governments that had opposed previous Alien Tort Statute cases to see whether they wanted to file a brief and whether they already had legal representation. But none of those he contacted were ready to commit, leaving him with no one to represent.

In November last year, Bellinger called Shell's lawyer, Kathleen Sullivan, who had been one of his professors at Harvard Law School. Sullivan, who declined to comment for this story, was preparing to argue the question that was before the Supreme Court at the time: whether the statute applied to corporations. Bellinger says she mentioned to him that former U.S. Solicitor General Paul Clement was writing a brief for IBM in support of Shell. IBM is one of dozens of corporations that are defendants in another case, brought by South Africans who suffered abuses under apartheid.

Clement, a 46-year-old conservative wunderkind, has argued more than 50 cases before the nation's top court. In late 2011 he was working on some of the nation's highest-profile cases, including defending Arizona's immigration law and a federal law that defines marriage as a union between a man and a woman.

Clement and Bellinger had worked together on an Alien Tort Statute case when Clement was solicitor general and Bellinger was at the State Department. When they spoke, the two lawyers decided to team up again. "Paul agreed," said Bellinger, "we could track a number of the issues we'd argued in government."

They divvied up the work. To build their case, Bellinger sought to document instances where foreign governments had complained about the statute. Clement's job was to look at the big picture.

In an interview, Clement said he saw two issues lower courts were grappling with. One was Bellinger's concern about whether the statute applied to cases where abuses were committed in foreign countries. The other was whether helping a foreign government commit an abuse, rather than committing the abuse directly, was covered by the statute. Only the 2nd Circuit's Kiobel decision had brought up the new question of whether a corporation, rather than an individual, could be held liable under the statute. It was almost as if the Supreme Court was looking at the wrong question, Clement said.

Like Bellinger, Clement agreed to speak only in a private capacity and not as a representative of his clients in the ongoing litigation.

The two lawyers said they decided they needed to marshal a much broader argument than the one the Supreme Court had asked for in Kiobel. Bellinger spent December 2011 reaching out to clients of Arnold and Porter who were past, current or potential future targets of lawsuits under the Alien Tort Statute.

In February this year they filed their brief on behalf of BP Plc, Caterpillar Inc, ConocoPhillips, General Electric Co, Honeywell International Inc and IBM. They argued that the Alien Tort Statute does not cover events that took place in foreign countries, nor does it apply to those who help others commit abuses, only those who commit abuses themselves. None of the six companies would comment for this story.

Jack Goldsmith, another lawyer who had worked in the Bush administration, filed a similar brief on behalf of Chevron. Goldsmith declined to talk about the pending litigation.

CHANGING THE QUESTION

On a crisp morning in late February, Paul Hoffman, a veteran human rights advocate, stood before the Supreme Court to argue the case for Kiobel. Some 16 years earlier, Hoffman had brought a landmark lawsuit under the Alien Tort Statute against oil company UNOCAL over abuses in Myanmar, which settled in 2005 for an undisclosed sum. Since then, bringing lawsuits against corporations had come to define his career.

Hoffman had hardly opened his mouth, however, when Justice Anthony Kennedy interrupted with a question that had nothing to do with corporate liability but rather to do with the reach of U.S. courts. Justice Samuel Alito jumped in next: "What business does a case like that have in the courts of the United States?" Then Chief Justice John Roberts joined the fray. The justices wanted to know if U.S. courts had any role in adjudicating events that took place overseas. Hoffman was under assault and struggled to get back to the question of corporate liability.

Bellinger, sitting two rows back in the public gallery, smiled. The justices were interested in his argument.

Just how interested became clear a few days later. The following Monday, Bellinger got a message on his BlackBerry. The court had asked the parties to come back and argue a new question: whether, and under what circumstances, the Alien Tort Statute applied to events on foreign soil. "It was a stunner," he said.

Clement was similarly surprised. "We didn't file the brief imagining that they were going to ask for reargument," he said. "We filed the brief thinking if the court said something favorable it would help our clients in lower courts."

When the Supreme court seeks a second round of oral arguments, it can portend a significant ruling. Brown v. Board of Education, the landmark 1954 case that ended segregation in public schools, was decided after reargument. In 2009 a second round of arguments in Citizens United v. Federal Election Commission was followed by a major decision on political spending by corporations and unions.

The court's decision to consider the wider question could have a major impact. As of August this year, there were 36 claims against corporations under the Alien Tort Statute. If the court had ruled for Shell on the narrower question - that the statute does not apply to corporations - 20 of those cases could be dismissed. However, those 20 cases could be changed to name individual corporate officers rather than the corporations as defendants. This would mean the cases could go forward. And while they would be harder to win, they would still create negative publicity. "It wouldn't stop the next wave of litigation," said Bellinger.

If, on the other hand, the court rules broadly for Shell, deciding that the statute does not apply to events on foreign soil, 29 of the current cases would likely be dismissed. The only cases that would remain are seven in which the alleged abuses took place on U.S. soil.

Earlier this month, Hoffman held a final strategy meeting at New York University Law School. His casual chinos and sneakers belied the seriousness of Monday's reargument for the survivors of human rights abuses. A ruling against the plaintiffs on the grounds that the events happened overseas would, he said, "rip the guts" out of the Alien Tort Statute.

NYC to round out skyline with tallest Ferris wheel

NEW YORK (AP) ? The Big Apple is getting another "biggest": the world's tallest Ferris wheel, part of an ambitious plan to draw New Yorkers and tourists alike to the city's so-called "forgotten borough."

The 625-foot-tall, $230 million New York Wheel is to grace a spot in Staten Island overlooking the Statue of Liberty and the downtown Manhattan skyline, offering a singular view as it sweeps higher than other big wheels like the Singapore Flyer, the London Eye and a "High Roller" planned for Las Vegas.

Designed to carry 1,440 passengers at a time, it's expected to draw 4.5 million people a year to a setting that also would include a 100-shop outlet mall and a 200-room hotel.

It will be "an attraction unlike any other in New York City ? in fact, it will be, we think, unlike any other on the planet," Mayor Michael Bloomberg said as he unveiled the plans against the backdrop of New York Harbor. While the privately financed project faces various reviews, officials hope to have the wheel turning by the end of 2015.

The wheel would put Staten Island on the map of superlatives in a place where "biggest" is almost an expectation ? home to the nation's biggest city population, busiest mass-transit system, even the biggest Applebee's restaurant.

The attraction stands to change the profile of the least populous and most remote of the city's five boroughs, a sometime municipal underdog that has taken insults from New Jersey and was once known for having the world's largest ... landfill.

"It's going to be a real icon. The Ferris wheel will be Staten Island's Eiffel Tower," Sen. Charles Schumer enthused.

As a visible addition to the skyline around the harbor, the wheel "gives Staten Island an identity beyond its role as a suburban community," while letting it tap into the stream of tourist money in a city that drew 50.9 million visitors last year, said Mitchell Moss, a New York University urban policy professor.

The project is expected to bring $500 million in private investment and 1,100 permanent jobs to the borough's St. George waterfront, and the developers will pay the city $2.5 million a year in rent for the land.

Staten Island isn't entirely off the tourist map. Its free ferry is the city's third-largest tourist attraction, carrying an estimated 2 million visitors a year alongside millions of residents, officials say.

But the city has long struggled to entice tourists off the boat and into Staten Island. Much-touted Staten Island sightseeing bus tours fizzled within a year in 2009 for lack of ridership.

Australian tourists Leah Field and Adam Lica, for example, were riding the ferry Thursday for its views of the Statue of Liberty. They thought they might have lunch on the Staten Island side but weren't planning to explore further.

"We weren't sure what there is to do there," explained Lica, 32, of Melbourne. But were there a giant Ferris wheel, the couple likely would go ride it, he said.

But Henriette Repmann, a German university student, said she wouldn't bother.

"You don't have to have the biggest Ferris wheel in the world to get a good view of New York," Repmann, 20, of Leipzig, said Thursday as she visited the Empire State Building.

Largely a bedroom community for other parts of the city, Staten Island boasts about 470,000 residents and a minor league ballpark, cultural sites and quirky attractions, from locations in the video for Madonna's "Papa Don't Preach" to the Staten Island Zoo, home to New York's answer to Pennsylvania's prognosticating groundhog. The Staten Island rodent bears the dubious distinction of having once bitten Bloomberg.

Documentary Filmmaker Chronicles the Lives of Local Taco Truck ...

Many locals have learned that if you want the most authentic mexican food in town, you visit a taco truck, preferably one on the West Side. But what goes on behind the scenes doesn?t always make it to the forefront of these businesses. Filmmaker Robert Lemon has been shooting a new documentary about the relationships surrounding these food trucks, their owners, their customers and their neighbors to capture the good and bad of what can happen when cultures intertwine.

We spoke recently with Lemon for a Q&A about his project:

Q: First, can you tell us a bit about your background as a documentary film maker?

A: I grew up with a video camera in my hand from the time I was 10 years old. I started my junior high news program when I was 13 and focused on videography through high school. I planned on going to film school and got side tracked with academia. So for twelve years I hadn?t touched a camera. Then a few years ago I realized film was the motivation I was missing in life. So I enrolled in a few film courses to get me up to speed on the digital world of filmmaking. Then I decided to shoot a short documentary to see if I still had any skills left from when I was a kid. The short doc I directed ended up in a number of film festivals and still plays occasionally at academic conferences, museums, and fundraisers. After my small success, I decided to go back into film. However, I?m using my knowledge and insight from my past 10 years of academic design and geography to help shape the narratives of my films. Besides this documentary I?m shooting here in Columbus, I?m also helping produce a short narrative in San Francisco called Hero Mars.

Q: So what drew you to the subject of Taco Trucks?

A: I came to the Ohio State University in the fall of 2004 to do my masters in city planning. At the time I also worked for the department of development in community services. I was working on the West Side of the city with Bonita Lee. She had told me that taco trucks were moving into the neighborhood and they were a high point of contestation amongst community groups. I found this interesting and started studying the social relationships around them.

Q: After watching the trailer for Transfusion, I?m reminded a bit of the Columbus documentary Flag Wars, which tells the story of long time Near East Side residents and the newcomer gentrifiers working to restore Olde Towne East. Does your documentary carry similar tones or cover similar topics?

A: Flag Wars is one of my favorite documentaries. Not necessarily for its content, but its overall production. (I watch films for their ability to tell stories that are visually engaging; the subject should be interesting to me if it?s well produced.) I didn?t come here to do a film on race on the east side of the city. I originally came here to do a story on the food trucks on the west side of the city and how things may have changed over the past 10 years. I have traveled around the country and have seen taco trucks in a number of settings, but I?ve never seen a taco truck in a black community. I started filming around the truck to see what people?s attitudes of the truck are. My film isn?t about gentrification, but about the relationships people build around food and how food is laden with social, racial, and political meanings. It?s a coincidence that I?m filming near Old Towne East and Flag Wars does cross my mind from time to time.

But it is also important to remember that in documentary filmmaking, hundreds of hours of footage is shot and the audience only gets to see 60-90 minutes of it in an extremely edited version. It?s the director?s filtered version of reality.

Q: Would you say that food plays an important role in the exchange of cultures or introduction of new cultures, and if so, why?

A: I?m finishing my PhD in human geography at UT-Austin where I study food, culture and urban space. I?ve found that ?culture? is an extremely difficult word to define and talk about. My approach to studying culture is to start by talking with individuals. Often individuals in a given area (who share similar demographics) tend to share similar attitudes. It is really peoples? shared attitudes towards new things and other people that shape interactions amongst community groups. Food can play a big part in this because the places where people eat food create social nodes, the dinner table for example. People in general like to eat, but not all people like to try new things. Additionally, the interesting thing is that food also changes. Most of the taco trucks in the city have adapted their menus to attract North American customers. The trucks have added burritos (which are from California), and even one truck now serves lasagna. So yes, food is a gateway for exchange of culture, but the food itself is also not easy to define, as the definition of what is ?authentic? is completely subjective to who is eating the food.

Q: What is the current status of the film?

A: The film is still in production. I have very little left to shoot and hope to be done filming by the end of September. I have shot around 40 hours of footage in Columbus and have 12 hours of footage from San Luis Potosi, SLP, Mexico. I may have to return one more time to Columbus if needed. I hope the film will be done with editing and released sometime in January.

Q: Anything else we should know?

A: Up until now I have been using my own salary to pay for the film. If people would like to donate to the production and editing of the film, there is a donate button on my website. The estimated cost of film right now is $15,000. I will also probably be doing a Kickstarter campaign in the near future. Regardless, I have enjoyed working on the film in the city and will make sure it?s completed in a timely manner. I have more items on the burner I need to complete, so this needs to be done!
