DWP lawsuits over water rights may put squeeze on Mammoth Lakes

MAMMOTH LAKES ? The people of this small High Sierra ski town have survived drought, forest fires and earthquakes. They have endured economic recessions and volcano scares. But nothing in their history prepared them for the Los Angeles Department of Water and Power.

The DWP launched a legal attack six months ago for control of the city's primary source of water, Mammoth Creek, which tumbles down the slopes through town. The utility contends it has owned the water since 1905 and Mammoth Lakes has been poaching for decades.

The tiny Mammoth Community Water District says that if it loses the lawsuits, the district would have to buy water from the DWP. That would force the district to raise average rates to levels many locals cannot afford ? increasing them by at least 100%, to about $840 a year, one district official said.

The 7,700 year-round residents are largely working-class employees catering to vacationers who travel 300 miles north from Los Angeles. Forty percent are low-income.

Greg Norby, manager of the water district, said the DWP is using the lawsuits to intimidate his agency, hoping it will yield on the water rather than pay for a costly court battle. The district has already run up about $300,000 in legal expenses in the case, he said.

In a county with a 12.1% unemployment rate and a city whose bad economy and debts have it on the verge of bankruptcy, the DWP lawsuits could be the last straw, Norby said.

"It would bring a huge return on their investment in attorneys' fees," Norby said. "Mammoth Lakes would cease to exist."

Mammoth Lakes argues that it is entitled to as much as 2,760 acre-feet of water annually under licenses and a permit granted by the state dating back as far as 1949. The district also argues the DWP should not be allowed to claim the water now after allowing the community to become dependent upon it for decades by relying on those licenses and permit.

"Los Angeles never protested any of them," Norby said. "Where the hell was the city 50 years ago?"

The DWP says the state had no authority to give Mammoth Lakes permission to draw from the creek.

Martin Adams, DWP's water project director, said Mammoth Lakes wasn't a big concern when the community was small. "But over the years, after growth spurts which included condos and golf courses, Mammoth's water diversions were no longer just a blip," Adams said. They are now equal to 1% of the flow of water in the aqueduct carrying water from the Eastern Sierra to Los Angeles, he said.

The lawsuits, filed in Mono County Superior Court, are part of a new assertiveness by the utility along the Eastern Sierra, where it has owned land and water rights since early in the last century. After long legal battles, the DWP has been forced to help restore land it drained by giving up water to maintain levels in Mono Lake, re-water parts of the dry Owens Lake and restore a 62-mile stretch of the Lower Owens River.

The utility believes the Owens Lake effort alone unfairly raises rates for its customers by an average of at least $20 a year. Facing an estimated $238-million budget deficit, the DWP is trying to increase revenue from the Eastern Sierra and put as much water as possible into the aqueduct to L.A.

"Every drop counts, and under the city charter we are mandated to protect every drop," Deputy City Atty. Bill Carter said. "The city of Los Angeles does not want to harm Mammoth or its residents."

The water war comes at an especially tough time for Mammoth Lakes.

Just five years ago, the city was almost debt-free, enjoying record snowfalls and a real estate boom. Every Friday night in winter, thousands of vehicles streamed up from Southern California, bringing an estimated 1.5 million skiers to the region during the season.

Since then, the median price of single-family homes in Mammoth Lakes has fallen from $900,000 to $541,000 ? a decline of 40%, according to a study by FTI Capital Advisors. The median price of condominiums has fallen from $560,000 to $270,000 ? or about 52% ? during the same period.

City leaders are preparing to file for bankruptcy because the community cannot afford to pay a $43-million breach-of-contract judgment against it brought by a major developer.

The city considered raising taxes but a financial analysis warned that tax increases would drive tourists elsewhere and devastate households. The area's largest employer, Mammoth Mountain ski resort, laid off 70 full-time employees last winter because of a dearth of snow.

"This town's been through tough times, but never like this," said Tom Cage, a business owner and member of the water district board. "I'm not saying we're going to become a ghost town with tumble weeds rolling down Main Street. But no one around here expects to see development for years to come."

After all, he added glumly, "there are lots of other places for people to go that aren't under the thumb of the DWP."

Under a "Stop the LADWP Water Grab!" campaign managed by the public relations firm Cerrell Associates, the Mammoth Lakes district recently began asking its ratepayers to flood the DWP and Los Angeles City Hall with complaints and hard-luck stories.

Many Eastern Sierra communities have existed as Los Angeles colonies of sorts since the early 1900s when the city acquired enormous swaths of Eastern Sierra land and began pumping so much water south that the region became a de facto desert wilderness. Resentment has festered for a century.

"The DWP is a rapacious agency," said Paul Rudder, a Mammoth Lakes lawyer for 40 years. "The people of Los Angeles aren't going to shed a lot of tears over a poor little mountain town being stepped on by an elephant."

State Sen. Alex Padilla (D-Pacoima) sent a letter to the DWP last week recommending that the agency work with Mammoth Lakes to find common ground. The letter to General Manager Ron Nichols said the dispute is "opening old wounds in the Owens River Valley and risks exacerbating the historic distrust of the City of Los Angeles and LADWP well beyond the Eastern Sierra."

Facebook app for iPhone to get speed boost

Facebook's iPhone app will be getting?a much-needed improvement in speed, something users have been complaining about for awhile.?

The social network is a rich?experience on the iPhone, but that richness has a lot of complexity behind it, and that has been contributing to making the app more tortoise-like.

Two Facebook engineers, speaking anonymously to the New York Times, said that the Facebook has rebuilt the app to optimize it for speed.

We asked Facebook about the change.?"We don't comment on rumor and speculation," a spokesperson told msnbc.com.

The engineers said the new app, due sometime this summer, is being mainly?built using Objective-C, the?programming language used to build apps for Apple's iOS. They told the Times that many of the components of the existing version of the Facebook app use Web-based?HTML5.

"The current version of the app is essentially an Objective-C shell with a Web browser inside.?When it comes to speed, this is like putting the engine of a Smart Car in the body of a Ferrari," said the Times.

Fox News poll: Nation divided on health care ... - Health and Fitness


As the country awaits the U.S. Supreme Court decision on health care, more American voters continue to oppose the law than favor it. ?In addition, voters are divided over what Congress should do if the high court rules parts or all of the 2010 law as unconstitutional. ?

A Fox News poll released Wednesday finds nearly half of voters oppose the law passed by Congress and signed into law by President Obama in 2010. ?Thirty-nine percent favor the law. ?Thirty-nine percent ? the exact same number ? also favored it at the time it was passed two years ago (April 2010). ?

What should happen if the court invalidates the entire health care law? ?The largest number of voters ? 47 percent ? thinks Congress should try to pass ?more modest? reforms. ?The rest divide evenly between the opposite ends of the spectrum: ?24 percent want Congress to keep pushing the issue and try to pass the ?most extensive? reforms it can, while another 24 percent want lawmakers to stay out of health care altogether.

The preference for moderation on health care extends across party lines. ?The largest number of both Democrats and Republicans pick the middle ground and think Congress should try to pass more modest reforms. ?Republicans are five times more likely than Democrats to say that if the court tosses out the law then Congress should do nothing on the issue.

If the justices toss out only the requirement that all Americans buy health insurance, views split: ?43 percent want lawmakers to scrap the whole law because it can?t work without the individual mandate and 42 percent want Congress to keep what?s left of the law and see what works.

Democrats (63 percent) think Congress should keep what?s left of the law, while Republicans (69 percent) say the whole thing has to go.

The Supreme Court is expected to announce its decision on the law Thursday. ?

In early June, the Fox poll found 38 percent wanted the Supreme Court to toss out the entire law, and another 21 percent wanted to keep most of the law, but invalidate the mandate for Americans to buy health insurance. ?Three in 10 said the court should let the entire law stand (June 3-5, 2012). ??In addition, 60 percent said the requirement to buy health insurance is a violation of individual rights protected by the Constitution.

Even if the court rules against the president?s major legislative accomplishment, he gets points for trying: ?54 percent of voters describe the time and energy Obama spent on health care reform as a ?worthwhile effort? ? even if it is invalidated. ?Forty-one percent see it as a ?waste of time.?

Most Democrats (83 percent) think it was a worthwhile effort, while most Republicans agree with Mitt Romney?s view that it was a waste (73 percent). ?A 53-percent majority of independents give Obama credit for trying. ?

Overall, by an eight percentage-point margin, more voters disapprove than approve of the president?s job performance on health care (51 percent disapprove, 43 percent approve). ??

One in five Democrats disapprove of Obama on health care (20 percent). ?

The Fox News poll is based on landline and cell phone interviews with 912 randomly-chosen registered voters nationwide and is conducted under the joint direction of Anderson Robbins Research (D) and Shaw Company Research (R) from June 24 to June 26. ?For the total sample, it has a margin of sampling error of plus or minus three percentage points. ?

Wyoming has most expensive auto repair costs

CarMD Reveals State-by-State Ranking of Car Repair Costs; Motorists in Wyoming Paid Most, Indiana Drivers Paid Least for Repairs

States experienced a drop in repair costs in 2011; Texas sets benchmark with national average

IRVINE, Calif. ? Drivers in Wyoming paid the most in the nation for car repairs at an average cost of $389.18, according to CarMD.com Corporation, which analyzed more than 160,000 repairs made on vehicles with "check engine" light problems in 2011. In Wyoming, home to two of the top 10 most visited national parks; motorists paid 17% more than the U.S. average for overall repairs, including 19% more for labor and 15% more for parts. Drivers in Indiana paid the least at $283.95 per transaction. Rounding out the top five most expensive states for car repair are no. 2 Utah, no. 3 California, no. 4 Montana and no. 5 Arizona. These states are home to half of the nation's national parks and many popular, yet remote and higher-elevation driving destinations. CarMD, a leading provider of automotive information and products, has developed the largest database of "check engine" repairs, and releases this list annually to empower drivers to make educated decisions that maximize vehicle life and minimize repair costs. "Each year, CarMD taps into our Vehicle Health Index repair database to monitor trends, including state-by-state and nationwide auto repair costs," says Art Jacobsen, vice president, CarMD. "We are encouraged to see overall repair costs trending down this year but recognize that drivers are still putting off small repairs such as spark plugs and oxygen sensors that can quickly turn into more serious problems. With the higher cost for repairs in popular western vacation destinations, our data illustrates the need for summer travelers to make preventative maintenance and vehicle safety checks paramount in their road-trip preparation."

Several interesting findings emerge when comparing state-by-state repair rankings. According to the CarMD? Vehicle Health Index?, the average cost of U.S. "check engine"-related auto repairs in 2011 was $333.93, including $215.32 in parts and $118.61 in labor. This figure is down 6% from 2010 repair costs, due in large part to a double-digit drop in labor costs. This isn't all good news for consumers. Industry contraction has a lot to do with the drop in labor rates, which are being partially offset by increased parts costs, and more severe repairs increasing in frequency and reaching the 10 most common problems list. Most states/districts experienced a drop in repair costs, with the exceptions being District of Columbia, Georgia, Maryland, Minnesota, Mississippi, Montana, Nebraska, North Carolina, Oklahoma, Tennessee and Utah.

CarMD also found that Texas paid closest to the national average for car repair costs at $333.75, just pennies less than the U.S. average. CarMD attributes Wyoming's no. 1 ranking to harsh weather and high altitude that may wreak havoc on vehicles. Another factor in Wyoming's ranking is its more remote locations with widespread and reduced access to parts and people to service them, which results in motorists' tendency to put off smaller repairs. This is clearly illustrated by the fact that catalytic converter repairs were the second most common reason the "check engine" light came on in Wyoming. It shouldn't even be in the top 10, let alone ranked second. This is a very expensive repair, and often the result of putting off smaller repairs.

"Just as you map your trip and make your hotel or campsite reservations, it's important to check your vehicle's health and pay attention to little nagging problems like diminishing fuel economy, squeaky brakes and especially the pesky 'check engine' light," says Jacobsen. "You will pay less and have peace of mind by getting your car looked at by your preferred mechanic on your own time and budget, versus being forced to make repairs when you're away from home and loaded down with luggage. Nothing will ruin a family vacation quicker than major car trouble when you are away from home."

Other key findings:

  • The top five states with the highest car repair costs are from the West, including Wyoming, Utah, California, Montana and Arizona.
  • This can partially be attributed to higher amounts of airborne dust. By putting off replacing air filters in western states, vehicle owners put their vehicles' mass air flow sensors at risk. On average, this is a $400 repair.
  • Three of five states with the lowest car repair costs are from the Midwest, including: Indiana, Wisconsin and Iowa. Rounding out the most affordable states for auto repair are Maine and New Hampshire from the Northeastern U.S.
  • Drivers in Vermont paid the least for labor at $98.90, with those in Colorado paying the most at $143.17 for labor.
  • Drivers in Maine paid the least for parts at an average of $175.91, with those in Wyoming paying the most ($247.70).
  • The no. 1 most common repair across the country in was "Replace Oxygen (O2) Sensor." A faulty O2 sensor is often ignored because it may seem like the vehicle is driving fine, but can actually lead to as much as a 40% reduction in fuel economy.
  • On average, motorists paid the least in Nebraska ($209.81) and the most in Illinois ($313.25) to have an O2 sensor replaced. The average cost to replace an O2 sensor, which measures the amount of unburned oxygen in the exhaust and tells a car's computer when there is too much or not enough fuel as compared with oxygen for ideal operation is $244.23 in the U.S.
  • In Wyoming, O2 sensors comprised 10.10% of repairs last year, at an average cost of $233.92. If ignored, a faulty O2 sensor can not only cause reduced fuel economy, but can also lead to more serious parts failures such as the catalytic converter. A faulty catalytic converter may then lead to complete engine seizure and roadside breakdown. "Replace Catalytic Converter(s)" accounted for 5.72% of repairs in Wyoming, at an average cost of $1,030.63. Original equipment parts are typically needed when replacing a catalytic converter. Catalytic converters contain three of the most precious metals ? platinum, palladium and rhodium. They are usually not stocked by smaller or more rural repair shops due to their high cost.

CarMD's state-by-state ranking of repair costs was derived from analysis of 163,582 repairs made from Jan. 1, 2011 through Dec. 31, 2011 by CarMD's network of Automotive Service Excellence-certified technicians. The repairs are related to a vehicle's "check engine" system, which is designed to alert drivers to large and small problems that affect emissions output and drivability. I know this seems like rambling, or I?m complaining more than something small, but I?m actually not. I have an MBA; I am a Certified Management Accountant; I am Certified in Financial Management; I spent 23 years in banking and as a business consultant. Two years ago I got disgruntled using the internal political machinery that constitute ?success? in corporate America and quit in order to search myself within the mirror at night. So I joined my wife to build a credible, honest business based on integrity. I became a Real estate agent.

What I located was that no one trusted me and that somewhat astounded me. Individuals thought I took a listing, sat back, watched TV, drank beer, and waited for someone to sell their property. I?m not making this up ? they definitely thought this. They complained about the fact I wasn?t doing anything for them.

Wow! Whenever they assume I wasn?t performing for them, they really should acquire a prolonged look at corporate America!

Now, get this, I would obtain these complaints around 8:30 p.m. while I was still inside the office functioning. For some reason, these clients didn?t add it up that it was 8:30 at night, and I was still at work. That is just what it takes to get all the phone calls answered or returned, the negotiations place to bed, the inspection issues resolved, the photos and virtual tours taken and posted, the newspaper ads ordered, the just listed cards sent out, the just sold cards sent, the monthly newsletter and other marketing materials inside the mail, the web-site and MLS updated, the flyers designed, printed, and delivered to the property, the books balanced, the supplies replenished, the equipment fixed, the computers/printers/fax kept operational, the emails go through and processed, the mail read and processed, all the paperwork completed perfectly and processed (the then verified for accuracy), the prospecting done, the consumer follow-ups finished (time permitting), the closings attended, the closing gifts purchased and delivered, the listing presentations prepared and made, the comparative market place analyses done, potential homes discovered for buyers, the potential homes shown to buyers, the bills paid, the mandatory schooling completed, the 800 numbers recorded, all amendments signed and filed correctly, putting out ?for sale? signs/lock boxes/flyer boxes (or picking them up after a sale), the open houses held, the flyers prepared and distributed in every single broker?s office in town for that open house, holding realtor luncheons, flyers prepared and distributed at just about every broker?s office in town for the realtor luncheon, buying and preparing the food for your realtor luncheons, talking to other agents to get feedback on household showings, and talking to others agents about our listings, fending off frivolous lawsuits, AND telling our clients that we ARE performing on selling their dwelling even when they don?t hear from us each and every day or even when they never see us doing anything.

That covers some of what our day is like. Each and every day is diverse, but that covers some of it.

My position?

Properly, if it isn?t obvious, how are Realtors rated so low? We are we with the bottom of the checklist of all professions? How is this attainable? With all due respect to employed car salesman (and I mean that ? I?ve met a handful of wonderful made use of vehicle salespeople), how can an accredited, ruled profession, subject to stringent ethical and educational standards, that costs thousands of dollars for every year just to apply (our charges to practice exceeded $50,000 last year), how can a profession that requires about 80+ hours of work for each week ? all week ? well, how can this occupation possiblly be less respectable than an occupation where NONE of these items are essential? It boggles the mind. Are there licensed applied car salespeople? Are they held to ethical standards? And ? give thought to this ? do they pay thousands to tens of thousands of dollars per year to become an employed car salesman?

This isn?t to say that each and every Realtor walks on water. No. Not even close. But neither does every single attorney, doctor, engineer, or accountant. There are levels of skill associated with all professions, including Realtors.

So, what I want you to know is that the polls aren?t justified. Yes, they reflect that Realtors are one from the minimum respectable professions in America, but the justification for this is MIA. I know, I worked in corporate America ideal next to hundreds of CPAs, engineers, systems analysts, programmers, and I lunched with CEO?s, COO?s, and multi-millionaire entreprenuers. I?ve seen it all, I?ve worked with them all, and truthfully, the best bunch (by far) I?ve at any time been associated with is the 130 agents in the Ebby Halliday Office in Arlington, Texas.

Are Realtors genuinely one in the minimum respected profession in America?

Get real, folks.

Use a licensed Real estate agent. I recommend you find one by getting a referral from someone you have faith in, but for heaven?s sake, use a licensed skilled.

For every Nationwide Association of Realtors statistics, you stand a 46 times greater chance of selling your property via a Real estate agent than on your personal, and on average (if you listen to your realtor?s suggestions) you?ll end receiving a larger cost for your home.

Oh, and you just might preserve yourself out of jail within the process.

Brain structure helps guide behavior by anticipating changing demands

ScienceDaily (June 24, 2012) ? Every day the human brain is presented with tasks ranging from the trivial to the complex. How much mental effort and attention are devoted to each task is usually determined in a split second and without conscious awareness. Now a study from Massachusetts General Hospital (MGH) researchers finds that a structure deep within the brain, believed to play an important role in regulating conscious control of goal-directed behavior, helps to optimize behavioral responses by predicting how difficult upcoming tasks will be. The report is receiving advance online publication in Nature.

"The dorsal anterior cingulate cortex (dACC), which lies deep beneath the outer layer of the frontal lobes, is part of an ancient and enigmatic part of the brain," says Emad Eskandar, MD, of the MGH Department of Neurosurgery, senior author of the Nature paper. "Some have speculated that it plays a role in detecting errors or monitoring for conflicting demands, but exactly how it contributes to regulating behavioral responses is unclear, so we used a variety of scientific techniques to get a better picture of its function."

The study enrolled six participants who were scheduled to undergo cingulotomy -- a procedure in which a small, precisely placed lesion is created within the ACC -- to treat severe obsessive compulsive disorder (OCD) that has not responded to other types of treatment. A standard part of the cingulotomy procedure involves microelectrode recordings of the activity of single neurons in the area where the lesion is to be placed. To evaluate dACC function, the investigators recorded brain activity from several neurons within the structure while participants performed a behavioral task testing their reactions to visual images.

The task presented participants with a random series of images of three numerals, which could be 0, 1, 2, or 3. In each image, two of the numerals were identical. Participants responded by pressing one of three buttons, the position of which would indicate the identity of the number that was different, with the left button indicating 1, the middle 2 and the right button 3. Each image was ranked in difficulty depending on how much the position of the target numeral or the identity of the duplicate numerals might distract participants from the correct response. For example, when presented with 3-3-2, the correct response would be to press the middle button for number 2; and that image would be ranked more difficult than 3-2-3, in which both the target number and the correct button were in the same position.

Functional magnetic resonance imaging (fMRI) of four participants performing the behavioral task prior to the cingulotomy procedure revealed that the task increased metabolic activity within the dACC, a result seen in previous fMRI studies. The fMRI images also revealed that responding to more difficult images produced greater activity levels within the dACC and in other structures known to be involved in decision making. Intraoperative microelectrode recordings of all participants demonstrated that this apparent increase in metabolic activity corresponded with an increase in neuronal activity, linking for the first time the increased activation revealed by fMRI with increased neuronal firing.

Analysis of individual neuron activity indicated that dACC neuronal activity remained elevated immediately after difficult trials. Moreover, participant reaction time revealed that the difficulty of the prior trial had an impact on the next trial: if the preceding trial was of the same level of difficulty, reaction time was shorter; if the two tests were of different difficulty levels -- even if the second test was easier -- reaction time was longer. By anticipating the difficulty of upcoming tasks, the authors note, it appears that the dACC speeds up responses when difficulty levels are constant but slows response time down when faced with changing demands in order to promote accuracy.

While behavioral tests conducted after the cingulotomy procedure -- which destroys tissue within the dACC -- did not indicate a change in participants' ability to perform the test accurately, the impact of preceding trials on reaction time appeared to vanish. "Participants could still perform the task, but the dACC's role of priming the system based on immediate prior experience was gone," Eskandar explains. "We believe this result indicates an important role for the dACC in rapidly adjusting to different cognitive demands, possibly by recruiting other areas of the brain to solve particular problems."

An associate professor of Surgery at Harvard Medical School, Eskandar adds that, while significant cognitive changes have not been reported in patients undergoing cingulotomy, the apparent role of the dACC in adapting to changing situations implies a possible role for the structure in several psychiataric disorders. "A lack of behavior flexibility and adjustment is characteristic of OCD, for example. Whether or not our findings directly relate to these disorders remains to be determined, but we hope that continued study using complex tasks, such as the behavioral test used here, will be helpful in diagnosing or monitoring psychiatric disorders."

Tiffany LaBanca, a senior vice president at News Corp., once used social media strictly for professional transactions until she realized there were "real people behind the avatars."

"It sounds simplistic," LaBanca told a gathering of? Twitter ?believers at The State of Now #140conf in New York City this week. "It was nothing short of a revelation."

Taking the stage, LaBanca recalled the tumultuous state of her life a year ago when a number of personal challenges coalesced around the tragic death of her neighbor?s 7-year-old son. ?"He was like my third child," she said.

Meanwhile, she was tweeting about social media strategy, sharing articles and engaging in polite business conversations. Then Vonage founder and tech startup investor Jeff Pulver spotted her.

It was about a year ago when, out of his half million or so followers, Pulver replied to her, finally writing, "We need to meet in real life." She thought he had an agenda.

"We were crying over pasta, sharing our life stories," she said. "We never talked about work at all."

It was the beginning of a major change for LaBanca, who had never considered how people online might become part of her life. She began to change her online persona, sharing what was happening with her neighbors, with her life. [ Twitter 'Stories' Site Shows the Impact of a Single Tweet ]

Simply finding one user who posts daily photos of the sunrise over Lake Michigan showed her "that life goes on and no matter how painful, that sun is going to continue to rise for us." She has made? Twitter friends ?with people from all over the world, whom she is now eager to meet. At the conference, she connected with two women she now calls "BFFs."

"This is about people. This is about humanity," she said. "The more connections that happen, the more beautiful life can be." While her life might look the same from the outside, she said the experience has been a personal revolution. "There?s a part of me that always doubted I could just step out and be who I am 100 percent. I always held [part of myself] back because of the vulnerability."

Translating interactions on Twitter into real-life taught LaBanca to be courageous. "The course of your life changes through the people you have the opportunity to meet," she said. And she credits Pulver for noticing her when she thought she was hiding online, and encouraging her to put herself forward more. "Believing in someone is the greatest gift you can give," LaBanca says.

What's the first thing you do when you get to a hotel room? Turn on the light, kick off your shoes and turn on the tube? If so, congratulations: you've likely just made a quick tour of the places in the room that harbor the most bacteria.?

Sure, there are a lot of bacteria in the bathroom. But that?s not the hottest spot for bugs. Some of the highest concentrations of microbes were on the light switch, the carpet and the television remote. The findings were presented at the American Society for Microbiology's 2012 general meeting. [Katie Kirsch et al., A Microbial Analysis of Environmental Surfaces in Hotel Rooms]

The researchers sampled 19 surfaces from nine hotel rooms in three different states. They found that 81 percent of those surfaces had at least some fecal bacteria on them. But, of course, not all of these bugs are going to make you sick. The study was in part to help inform cleaning protocols.?

Some hotel chains are already pledging to keep their properties a little more germ-free. So your next stay might be a little cleaner. Just don't investigate CSI-style with a black light. You?ll never be able to sleep.

TV rating for U.S. Open rises

The U.S. Open's return to prime time boosted its television ratings.

Sunday's final-round coverage of Webb Simpson's victory at The Olympic Club in San Francisco earned a 6.6 overnight rating on NBC. Network officials said that was up 29 percent from last year, when coverage started and ended earlier with the tournament on the East Coast.

But Sunday's rating was down from the previous two U.S. Opens played in California, when play also took place in prime time in some regions of the country. The 2008 Open's fourth round got an 8.5 rating and the 2010 Open's final round had a 6.9 rating.

Nalbandian loses money

David Nalbandian of Argentina was fined the maximum $12,560 for unsportsmanlike conduct and placed under police investigation for assault after kicking an advertising board and thus injuring a line judge during the Queen's Club final Sunday in London.

Dr. Dre, Eminem Break Down Writing Process In 'Art Of Rap'

Ice-T dug deep into his rolodex to bring out all-stars while filming his new documentary, "Something From Nothing: The Art of Rap." The film, which opened in theaters Friday, includes appearances from legends like KRS-One and Melle Mel, to current powerhouses like Dr. Dre and his protégé Eminem.

During his recent visit to "RapFix Live," Ice-T discussed the process of putting the film together, explaining that Dr. Dre and Eminem both made important contributions to the finished product. Ice caught up with Dr. Dre at his California home for an important chat about hip-hop's past and present, during which he broke down the difference between writing regular rhymes and being able to craft a song, while detailing his memories of recording with Tupac.

"[Dre] said there's a difference between a rapper and a songwriter," Ice-T explained of his conversation with the legendary West Coast producer. "Dre says, 'You've gotta write me a song. I don't need bars — I know you've got skills, but we need songs, so give me the hook first.' He says a lot of rappers get lost, but that's what Eminem does. They write these incredible songs, and that's basically what Dre likes to take to the marketplace."

In the documentary, Ice-T also links up with Eminem in the studio, where the Detroit native explains that being a white rapper forced him to work harder to prove himself. During the conversation, Eminem broke down his method of writing rhymes, but it's hard to say that the explanation really clarified things. Of the Shady Records CEO's explanation of his complicated rhyme scheme, Ice said, "It was like you were listening to a scientist."

Keeping your balance on life's tightropes

A Christian Science perspective: Nik Wallenda?s walk across Niagara Falls may have lessons for walking life?s less dramatic tightropes.

In the breathtaking vastness of Niagara Falls, a lone figure moves slowly but surely along what seems to be a pencil-thin path, suspended high above the raging waters below. Holding a long pole horizontally for balance, this solitary adventurer places one foot in front of the other with tremendous concentration as he pursues his goal: to get to the other side.

Despite the commercial hoopla and sensationalism surrounding the event, this is what the high-wire artist Nik Wallenda did last Friday night in his walk across the 1,800-foot span over Niagara Falls, held above the foaming waters only by a two-inch-wide cable, skill and confidence developed over many years, and a single-minded courageous focus, closely allied to faith.

Are there spiritual lessons to be learned from such a daring event that perhaps can be applied in more ordinary circumstances? Mary Baker Eddy, the author of the Christian Science textbook, ?Science and Health with Key to the Scriptures,? thought there were. In her era, a French acrobat named Jean Fran?ois Blondin first walked a tightrope across Niagara Falls in 1859. The event attracted a great deal of attention at the time, and Blondin?s name became synonymous with courage.

Mrs. Eddy saw Blondin?s achievement in these terms: ?Had Blondin believed it impossible to walk the rope over Niagara?s abyss of waters, he could never have done it. His belief that he could do it gave his thought-forces, called muscles, their flexibility and power which the unscientific might attribute to a lubricating oil. His fear must have disappeared before his power of putting resolve into action could appear? (Science and Health, p. 199).

Obviously Blondin?s and Mr. Wallenda?s feats belong to the category of the unusual and incredible. But there is much of value that can be inferred from what their accomplishments represent.

Though Wallenda agreed to wear a safety harness at the insistence of broadcasters, his accomplishment is undiminished by that concession. Wallenda regarded walking the tightrope with a tether as more difficult than without it.

Blondin apparently had his own kind of safety net: his total fearlessness and conviction that he could perform the feat. Eddy offers an explanation: ?The feats of the gymnast prove that latent mental fears are subdued by him. The devotion of thought to an honest achievement makes the achievement possible. Exceptions only confirm this rule, proving that failure is occasioned by a too feeble faith? (Science and Health, p. 199).

How many times are we in the middle of a task or working out a problem when doubt in our ability tries to come in, causing our faith to feel a little ?feeble?? Maybe we?re tempted to stop trying so hard or give up completely ? a mental posture that?s not a realistic option when you?re halfway across Niagara Falls on a tightrope.

At times like these, I find it helpful to consider where our faith can most reliably reside. Is our only option to have faith in just ourselves ? whatever talents, strengths, and abilities we might have? Or can we put our faith in something more?

The Bible assures us that whatever challenge or endeavor lies in front of us, it is God, the source and giver of all ability and strength, that is the power in which we can and should have confidence. The book of Proverbs tells us, ?The Lord shall be thy confidence, and shall keep thy foot from being taken? (3:26). Human abilities are finite and fallible; God is infinite and worthy of our trust.

The journey through life may sometimes seem like a challenging trajectory through which we need the spiritual equivalent of a balancing pole to keep our poise and equilibrium. We can know that if we?re sincerely trying to tread a straight and narrow way, we needn?t fear falling, for God will uphold us. ?Fear thou not; for I am with thee:... I will strengthen thee; yea, I will help thee; yea, I will uphold thee with the right hand of my righteousness? (Isaiah 41:10).

So if we feel we?re on a kind of tightrope over frightening physical symptoms, financial circumstances that appear to be beyond redemption, or the tumult of a difficult relationship, God is with us, strengthening, guiding, and making sure that we can keep our balance, and get to the other side.

Million-dollar earners making a comeback

The Tax Foundation has a fascinating new post?looking at the latest IRS data on "millionaires," by which it means taxpayers who report more than $1 million in annual income.

The number of million-dollar earners fell 40 percent in the financial industry meltdown and Great Recession of 2007-2009 before making a comeback in 2010, the most recent year available.

In 2010 about 268,000 taxpayers reported adjusted gross income of $1 million or more, up from 237,000 in 2009, which was a six-year low.

Of course millionaires represent just a tiny fraction of the nation's 143 million taxpayers -- just a small sliver of the top 1 percent. (It's about the top 0.2 percent.)

And while millionaires are making a comeback, the picture has been less promising for the vast millions of the middle class. A census report last fall showed that the nation's median income was $49,445 in 2010, a decline of 2.3 percent from 2009 when adjusted for inflation.

The Tax Foundation report shows that the nation's wealthiest earners typically share a few traits: They are older, well educated and tend to have more than one income in the household.

WASHINGTON (AP) ? Republican presidential candidate Mitt Romney's frequent remarks about the nation's unemployment problem have long included one curiosity, if not an outright contradiction: It's bad for private-sector workers to lose their jobs, he says, but it's often good for government workers to do so.

Romney's positions on employment are drawing new attention after his back-to-back comments about firefighters, police officers and teachers. The nation doesn't need more of these workers, Romney said last Friday. And the federal government doesn't pay for them, he said Tuesday, after Democrats harshly criticized him.

The first statement can be debated. The second claim is simply false because the federal government spends billions of dollars a year to pay for teachers, police officers and firefighters throughout the country.

It's true that local governments generally hire such workers. But they use a mix of local, state and federal money to pay them. Romney would have been on firmer ground had he said the federal government doesn't "hire" teachers, police and firefighters.

What's clear is that U.S. communities would have fewer such public-sector workers if the federal government stopped funding teachers through Title I, police officers through the COPS program and firefighters through the SAFER program.

Romney sometimes suggests that firing a government employee can directly lead to the hiring of one or more private-sector workers. He told Colorado voters last month that President Barack Obama's stimulus program "didn't help private-sector jobs. It helped preserve government jobs."

The place to cut back, Romney said, "was on government jobs. We have 145,000 more government workers under this president. Let's send them home and put you back to work."

Numerous independent economists have said the stimulus prevented the economic collapse, including private and public-sector jobs losses, from being worse.

As for any increase in government employment since Obama took office in January 2009, that is true only if it refers solely to federal workers, and many of those were hired in areas Romney supports, such as the military and veterans' affairs.

Meanwhile, hundreds of thousands of state, county and municipal workers have been laid off as local governments cope with ailing economies and decreased federal aid. The Bureau of Labor Statistics says 607,000 government jobs ? all of them nonfederal ? have been lost since January 2009.

From a statistical standpoint, a laid-off government worker adds one name to the unemployment rolls, just as a laid-off private worker does. Economists and partisans debate the degree to which a smaller bureaucracy can lead to lower taxes, and perhaps less regulation, which might spur private expansion and hiring.

The latest back-and-forth over Romney's remarks began Friday. That morning, Obama, trying to note the difference between private-sector job losses and nongovernment job growth, told reporters "the private sector is doing fine."

The private sector has added 847,000 jobs so far this year. But Obama's phrasing made him sound out of touch with Americans' anxiety, and Romney was among those who pounced.

Obama "wants to hire more government workers," Romney said in Iowa, alluding to neighboring Wisconsin, where GOP Gov. Scott Walker had just triumphed in a recall election triggered by his attacks on public-sector employee unions. "He says we need more firemen, more policemen, more teachers. Did he not get the message in Wisconsin? The American people did. It's time for us to cut back on government and help the American people."

Democrats, eager to change the subject from the president's verbal misstep, counterattacked. Obama campaign spokesman Ben LaBolt said Romney was "calling for further job loss in the sector that needs the most urgent boost."

Other Democrats noted the federal role in putting teachers in schools and police on the streets. Title I funding for school personnel was $14.5 billion this year, the Senate Appropriations Committee said. Federal grants to states for special education reached $11.5 billion.

Millions of federal dollars put police and firefighters in various communities.

On Fox News on Tuesday, Romney rejected claims that his policies would worsen unemployment and deprive communities of needed services.

"Teachers and firemen and policemen are hired at the local level, and also by states," Romney said. "The federal government doesn't pay for teachers, firefighters or policemen. So obviously, that's completely absurd."

That triggered a new round of criticisms of Romney's understanding of federal aid to state and local governments.

Since then, Romney's "firemen" remarks and Obama's "private sector is doing fine" comment have been endlessly rehashed in campaign videos, news releases, cable TV, talk radio and elsewhere. They are virtually certain to live on in political ads in at least a dozen competitive states through Nov. 6.
