NY judge denies Apple Inc. request in e-books case

(AP) ? A judge on Friday refused a request by Apple to temporarily suspend her ruling that it violated antitrust laws by conspiring with publishers to raise electronic book prices in 2010, and she said it appeared collusion was continuing even after her findings.

U.S. District Judge Denise Cote, ruling from the bench in Manhattan, declined to withdraw the effect of last month's ruling while Cupertino, Calif.-based Apple Inc. appeals.

The judge said she wasn't ready to rule on the government's suggested remedies to eliminate antitrust behavior. She seemed dismayed as she noted that the publishers and Apple seemed to express together their opposition to some government recommendations, "reflecting a seriously continuing danger of collusion."

Apple, the maker of iPods, iPads and iPhones, continues to fight what it calls "false accusations."

The judge ruled last month that Apple had conspired with publishers to spoil the $9.99 e-book price Amazon.com had established. That ruling sided with government regulators' contention that Apple joined five major book publishers to gang up on Amazon to the detriment of consumers.

Apple, determined to protect one of the world's most beloved brands, has steadfastly denied it did anything wrong, even as the book publishers involved in the case settled to avoid going to trial.

The trial revealed e-book prices rose after Apple signed with publishers so-called agency agreements, in which publishers rather than retailers set prices for each title.

Earlier this week, publishers that have settled the e-book pricing dispute with the federal government objected to penalties the government wants to impose on Apple, saying they'll hurt publishers rather than the personal electronics company.

In court papers submitted on Wednesday, five publishers said the government's plans to ban Apple from engaging in agency agreements for five years wouldn't restrict Apple's pricing behavior.

"Rather, under the guise of punishing Apple, they effectively punish the settling defendants by prohibiting agreements with Apple using an agency model," lawyers for the publishers said.

As recommended by the government, a court order would require Apple to terminate any agency agreement with publishers.

The judge said Friday that any order she signs will be aimed at getting "us to a world" in which a publisher can negotiate independently with a retailer. She said it was clear that the largest book publishers don't engage in price competition with one another.

The publishers said the proposed remedy conflicts with consent decrees the publishers agreed to when they settled their cases with the government. Those deals permit the publishers to enter agency deals with e-book retailers with some agreed-to limitations.

The publishers said the Department of Justice "induced publishers to enter these agreements on the condition that publishers could continue to use the agency model." As a result, the court papers said, the publishers entered agency agreements with Apple and other e-book retailers under the agency model. Breaking those deals would be costly and disrupt business, they said.

The court papers were submitted on behalf of HarperCollins Publishers LLC, Hachette Book Group Inc., Simon & Schuster Inc., Holtzbrinck Publishers LLC and Penguin Random House LLC.

A Department of Justice spokeswoman has said the proposed settlement with Apple would prohibit the company from entering deals that limit retail price competition during a defined period.

Open Diff ? What are your automotive pet peeves? | Hemmings Daily

I?m rather disappointed. After my post on the 1952 Mercury woodie wagon that sold at the recent RM St. John?s auction, I fully expected commenter Get It Right to weigh in ? as he/she does every time we write about woodies ? to tell me that it should be spelled ?woody,? not ?woodies.? I?d believe that Get It Right is actually one of our copy editors posting anonymously if it weren?t for the fact that our copy editors could easily go in and change the spelling themselves. (For the record, ?woodie? is the accepted spelling of the National Woodie Club, and who am I to argue with a club full of woodie enthusiasts about how they spell their favorite vehicle?)

But Get It Right isn?t the only one of our commenters with a specific automotive pet peeve, as I?ve come to find out over the last several years conversing with everybody who reads and comments on the Hemmings Daily. For example, Mal Fuller seems to be leading the campaign against the use of the 1964-1/2 model year designation for early 1965 Ford Mustangs, and a number of you have repeatedly weighed in with pet peeves ranging from the overuse of the word ?classic? to the improper application of Kelsey-Hayes wire wheels on mid-1950s Chryslers.

So, this is your chance to fire away with your own automotive pet peeves. Let loose your inner pedant. Release your OCDemons. Dazzle us with that one bit of automotive trivia that everybody seems to get wrong. Hopefully, we?ll all reach some sort of catharsis by doing so, and we?ll all come away learning something for it.

By the way, just a reminder that the comments here are for civil and on-topic discussion. Stray too far off-topic, start calling people names, or generally make a nuisance of yourself and your commenting privileges will get yanked. That goes for this post and every other post on this blog.

Effort to stop 'Apple picking' phone theft now extends to London?

Phones are an easy target for street theft.

Smartphones are a hot item, both in stores and on the street, as anyone who has had their device stolen can attest. A group of police and officials from New York and San Francisco is hoping to pressure the phone makers into making theft of the phones more difficult and less rewarding, and the effort has just been joined by London Mayor Boris Johnson.

The "Secure Our Smartphones" program began earlier this year as a "coalition" of people in government and law enforcement who are fed up with how common ? and easy ? smartphone theft is. It was started by New York State Attorney General Eric Schneiderman and San Francisco District Attorney George Gasc?n.

Someone walking down the street talking on their phone could have it nicked right out of their hand, and with a few taps the thief can make the device their own. It's a serious problem ? the NYPD had to establish a task force specifically to deal with iPhone thefts.

Johnson agrees. "Cities like London, New York and San Francisco all face the same challenge," says in a press release. "And that is why London is joining the Secure Our Smartphones campaign to help find a global solution. We need the industry to take this issue seriously and come up with a technical solution that can squash the illegal smartphone market that is fueling this crime."

Software like Apple's "Find my iPhone" and Google's new "Android Device Manager" let users locate or wipe a stolen or lost phone, but that's no deterrent to the thief, who can still sell it on Craigslist for a few hundred bucks.

Secure Our Smartphones is pressuring phone makers into making such thefts more difficult to do, or if that isn't possible, then making a "kill switch" that permanently nukes the phone, preventing thieves from profiting by stealing it, and deterring them from attempting the crime in the first place.

Whether it will stimulate manufacturers and software developers who create smartphones remains to be seen, but a program like this could at least help raise awareness of this pervasive category of crime.

Bridging Finance is referred as bridge loans. And it has nothing to do with the construction work of any bridge. It is simply a way to minimize the economical problem between two transactions. Generally these are short term loan and carries high interest rate. These are easily available and neither these requires any credit record. Ted Cruz and the shutdown caucus

Who?s afraid of a government shutdown? Not Texas Republican Sen. Ted Cruz.

?There are some Democrats, some in the media and some Republicans who portray a shutdown as a horrible calamity. I think the term ?shutdown? is a misnomer,? Cruz said Tuesday during a luncheon with conservative activists and bloggers at the Heritage Foundation. ?It?s actually a partial, temporary shutdown. We have seen them before.?

These ?partial, temporary? shutdowns, Cruz argued, happen ?every single week on the weekend. Saturdays and Sundays we see temporary partial government shutdowns, and the world doesn?t end.?

A shutdown could even help conservative causes, Cruz added, pointing to balanced federal budgets that occurred after two shutdowns under former President Bill Clinton in the 1990s.

So, no big deal, right? Three cheers for shutdowns! Well, not everyone would agree, and that includes plenty of Republicans.

?We?ve been down that road,? Georgia Republican Sen. Saxby Chambliss said on MSNBC?s ?Morning Joe? Friday. ?We got our butts kicked over shutting down the government.?

The reason Cruz is dropping the S-H-word in polite company is because he?s part of an effort in the Senate to refuse support for any government-spending bill that includes funding for the Affordable Care Act. (In order to avoid a shutdown, both chambers of Congress must agree to a spending bill within the next two months, before the previous spending bill expires.) A trio of conservative Republican senators, which includes Cruz, Marco Rubio of Florida and Mike Lee of Utah, are urging members of the party to sign on to their ultimatum.

They seem to have the conservative base on their side. In July, Cruz introduced a bill to defund the health insurance law that has co-sponsorships from dozens of Republican senators, including Mitch ??McConnell, the top Republican in the chamber. Earlier this week, several right-wing groups and prominent conservatives signed on to a letter showing support for Cruz?s cause.

But support from the usual suspects and a vote on a bill that will almost surely fail in the Democrat-led Senate won?t be enough to actually defund the health law. For the plan to work, Cruz needs Republicans to risk shutting down the government by not voting on the final spending bill, and he?s not finding enough takers.

?There are an awful lot of politicians in Washington who love empty, symbolic votes. It?s been one of my biggest surprises in the Senate,? Cruz said at Heritage. ?A lot of Republicans are nervous about this. They?re nervous about being blamed for a government shutdown.?

For those Republicans who do support his bill but then go on to vote for a spending bill that funds the health law, Cruz has a message: ?Any elected official who casts a vote for this continuing resolution that funds Obamacare is affirmatively voting to fund Obamacare,? he said.

The remark will no doubt enrage plenty of Republicans who consider it more important to keep the government running than to die on the hill called Obamacare.

Republicans who vote for Cruz's bill but then go on to vote for the final spending bill after Cruz's bill fails would be making a calculated decision. They know that the Democrat-led Senate would not defund President Barack Obama?s most prominent legislative achievement. And even if the Cruz bill passed, they could be assured that Obama would not just roll over and sign it. It is perhaps because of that reality that Cruz is struggling to find 41 Republicans in the Senate or 218 in the House to join him in his quest.

But by remaining stalwart, Cruz and those who join him will always be able to set themselves apart from the rest of the gang in Washington and say that they have never voted to fund Obamacare.

Yusuf Kosoko, 26, purchased nine shares of Facebook on their first day of trading in May 2012 and picked up another three shares this week after the stock topped its IPO price for the first time.

26-year-old Yusuf Kosoko initially bought nine shares of Facebook (FB) on their first day of trading in May 2012. While he's still down about 11% on that investment, he picked up another three shares Wednesday afternoon for a little less than $37 apiece.

He's in it for the long haul.

"Facebook has billions of users, and lots of data about their likes and behavior," said Kosoko, an operations research graduate student at Columbia University. "Eventually, they'll be able to monetize all of this data."

As Facebook's mobile strategy continues to gain traction, and the negativity surrounding its botched IPO continues to dissipate, Kosoko thinks the stock has nowhere to go but up.

"Now that it's finally broken through the IPO level, I can see Facebook's stock pushing $80 a share next year," he said, noting that shares of Facebook have already more than doubled from their all-time lows last year.

Fellow Facebook IPO investor Joe Sprott is less optimistic.

Sprott made a $15,000 investment in Facebook on day one last year, paying $38 a share. He's waiting for the stock to inch a little bit higher in order to cover the trading fees he's incurred before he sells.

But he's not bailing completely. Sprott still plans to keep 25% of his stake intact. .

"I'll hold on to a little bit in case something amazing happens, but I don't think that will be the case," said Sprott, a 28-year-old project manager at a Washington, D.C.-based web design agency. "I think Facebook will continue to grow, evolve, and remain an online force, but I'm not sure it will be the same company it is now in three to five years."

Meanwhile, Barry Graubart, who wanted to buy $10,000 worth of shares the day Facebook went public but was shut out due to Nasdaq's trading glitches, remains relieved he doesn't own the stock.

"They've done a better job in building their advertising revenue and with their mobile product, but it doesn't really change my view of Facebook as an investment opportunity," said Graubart, adding that he doesn't find Facebook's ad strategy to be particularly innovative.

Graubart concedes that Facebook will likely maintain a strong audience and generate revenue in the near-term, but he's less certain about whether Facebook will be able to continue to attract new users.

"I look at teens who don't have any interest in Facebook today, and am not sure that their growth won't level off or drift downward in the next few years," he said. "I continue to root for their success, which I think is good for the technology and brand markets, but I'm unlikely to invest." To top of page

Apple Meets with Head of China Mobile to Discuss Potential Deal

Tim Cook?s trip to China was said to include a visit with the head of the largest carrier in the world, China Mobile, as Apple?s chief executive continues to work toward a potential partnership. The meeting between Cook and China Mobile Chairman Xi Guohua took place in Beijing, and was confirmed by the carrier to Reuters. The two sides met to discuss ?matters of cooperation,? but no other details were provided.

Speculation points towards a potential deal between Apple and China Mobile for some time. Cook most recently met with China Mobile in January but the carrier still has yet to offer the iPhone. Currently the iPhone is available on carriers China Unicom and China Telecom.

China Mobile was said to have 15 million unofficial iPhone users on its network as of March of 2012. It is also said to host roughly 715 million subscribers with only 13% of those being on high-speed 3G networks. The carrier hopes to rectify that by investing $6.7 billion to build out its 4G technology while it?s been speculated that Qualcomm?s latest LTE chips could allow Apple to have true global high-speed data support for carriers like China Mobile with its next iPhone update.

Cook is said to have also met with carrier China Telecom on his current trip to China. With Apple rumored to be planning to release a new entry-level plastic iPhone in the coming months, observers have speculated that device could have been a key point of discussion between the two companies. We?ll have to wait and see what comes out of Cook?s visit to China when more concrete information is revealed.
